You can definitely sue a residential care facility for the elderly, or RCFE, just like a skilled nursing facility. One of the issues we find is that they often accept residents they shouldn’t. These are people with medically complex problems who, frankly, shouldn’t be in RCFEs. For instance, we had a case recently with a woman who was non-verbal, immobile, and had all kinds of medical issues, including advanced dementia. They accepted her into an RCFE and didn’t provide the care she needed. She needed a higher level of care. She developed a horrible pressure ulcer, and was malnourished and dehydrated. That led to sepsis and her eventual passing. Around the time she passed away, her weight had decreased to less than 70 pounds.
