Why Trust Our Proven San Francisco Nursing Home Abuse Attorneys with Your Loved One’s Case

They know from our track record that we can win in court and will not settle for less than our clients deserve.

Client testimonials and reviews like the following reflect the care and hard work we put into every case:

“Our attorney and the entire staff at this firm were remarkable. Especially Emily, who walked us through everything in the beginning of the process.  They worked wonders for our family and our mother, whom they represented. They are quick, as much as they can be in the entire process,  as well as informative, and were in constant contact with us through the entire process. I would wholeheartedly recommend this firm to anyone.  They work wonders, and if for some reason are unable to, they let you know as soon as possible so you can make a well-thought-out decision for your next step.”

Carmel E.

“I had a wonderful experience with Jim and Lanzone Morgan, LLP. It was a very difficult situation — my mother had really suffered at the hands of a dreadful nursing home. I was so upset watching her that I decided to sue the nursing home. It was my first experience with a lawsuit of any kind. Jim and his firm were kind, always communicated clearly, and responded immediately. He patiently talked me through each step and was honest about our chances to (not good) walk away with a settlement. We did, eventually, win a monetary settlement!! What a nice surprise. Owing, I’m sure, to the firm’s expertise. For a first experience with a lawsuit, it was very pleasant. But best of all was knowing that there were consequences for the nursing home and their horrendous treatment of my mother. Thank you, Jim and Co!!”

Compensation for Your Loved One’s Nursing Home Abuse Injuries

Your loved one may be entitled to substantial damages for mental and physical injuries stemming from nursing home abuse and neglect, which may include the following:

  • Economic damages – compensate for financial losses, such as medical bills, mental health therapy expenses, costs of transferring a resident to a new facility, stolen property, and your lost wages
  • Non-economic damages – compensate for subjective losses, such as pain and suffering, loss of bodily functions, loss of independence, humiliation, and emotional distress
  • Punitive damages – damages awarded to punish the facility for gross negligence or intentional harm and deter future misconduct

If your loved one has died from nursing home abuse, you may be entitled to recover damages through a wrongful death lawsuit. Such damages may include funeral expenses, your loved one’s pain and suffering, loss of companionship, and similar losses.

How Much Is My Loved One’s Nursing Home Abuse Claim Worth?

The compensation recoverable in a nursing home abuse case depends on the severity of the abuse, the nature of the misconduct, the strength of the evidence, the severity of the injuries, and the skill of your San Francisco nursing home abuse attorney. We have recovered numerous six and seven-figure settlements and verdicts for elder abuse injuries, including the following:

  • $3 million settlement for a resident who suffered a coccyx bed sore due to neglect at a skilled nursing facility
  • $2.3 million verdict for a resident who suffered multiple falls in a nursing home and sustained a broken arm and pelvis
  • $2.3 million verdict for an 84-year-old nursing home resident who suffered severe and permanent injuries from nursing home abuse
  • $1.3 million verdict for a client who was injured in the shower in a nursing home facility while her mother was helping her because staff refused, claiming she could shower without assistance
  • $1.25 million settlement for an elderly assisted living facility resident who acquired a bedsore due to neglect
  • $1.2 million settlement against a doctor and a nursing home that allowed a resident to starve to death

The Nursing Home Abuse Crisis in the San Francisco Bay Area

Nursing home abuse and neglect are tragically all too common throughout the Bay Area.

Bay Area Nursing Home Abuse Cases in the News

One of California’s most infamous nursing home abuse cases occurred in San Francisco at the Laguna Honda Hospital’s skilled nursing facility. The San Francisco Examiner reported that investigators uncovered severe verbal, emotional, physical, and sexual abuse that affected as many as 130 patients. The substantiated incidents involved nurses and staff committing the following outrageous acts:

  • Kicking patients
  • Photographing patients nude and sharing the photos
  • Having sexually explicit conversations with patients
  • Using unprescribed opiates and other medications as chemical restraints
  • Gagging a patient with a towel

Medicare decertified the facility in 2022 but reinstated it in 2024. The City of San Francisco agreed to a $2 million settlement to compensate 11 victims.

We have also seen cases of poisoning in Bay Area nursing homes. A worker in Walnut Creek in Contra Costa County was charged with felony elder abuse in the poisoning death of a 94-year-old resident of the memory care unit at Atria Walnut Creek. A similar incident occurred at Atria Park of San Mateo, in which nursing home staff served dishwashing soap to residents, resulting in the death of a 93-year-old resident and the hospitalization of two others.

Nursing Home Abuse Uncovered in State Inspections of Nursing Homes in San Francisco, CA

Medicare’s nursing home informational website shows that 28 of the 120 nursing homes in the Greater San Francisco area have been cited for abuse. This occurs when state inspectors find that anyone has abused a resident, including staff, visitors, vendors, and other residents.

In 2024, state inspectors responding to a complaint found that a violent resident at Eden Healthcare Center had assaulted a bedridden, vulnerable resident. The facility knew the resident had a history of violence but assigned the resident as a roommate of the bedridden resident. The victim suffered a concussion, a broken cheekbone, and a lacerated scalp.

San Francisco Nursing Home Residents Have Rights

California laws and regulations guarantee nursing home residents the right to receive quality care in a safe, homelike environment. Federal law also guarantees residents the following rights:

  • To receive the necessary care to achieve the highest physical, mental, and psychosocial well-being and quality of life practicable
  • To be treated with dignity
  • To live in a home-like environment
  • To receive appetizing food that accommodates preferences and restrictions
  • To receive care to prevent bed sores and incontinence
  • To receive reasonable accommodations so they can enjoy as much independence as possible
  • To access enriching activities
  • To give informed consent for procedures and medications
  • To be free of medically unnecessary chemical and physical restraints
  • To be free of involuntary seclusion
  • To make decisions about their health care and control their schedule and activities

You Must Act Quickly To Get Justice for Elder Abuse in San Francisco, CA

The statute of limitations for California nursing home abuse and neglect cases varies based on multiple factors. Nursing home abuse cases involving medical malpractice generally must be filed within three years of the incident or one year after the injury is discovered. Elder abuse cases generally must be filed within two years. However, the law includes numerous exceptions, such as when the defendant is a government entity or the plaintiff lacks capacity.

Consult an attorney as soon as possible when you suspect abuse. Your attorney can determine what deadlines apply to your case. We often find that a case has elements of medical malpractice and elder abuse. Determining the statute of limitations in these cases can be complex, and it is crucial to get this right. If you guess wrong and miss the deadline, you will lose out on your opportunity to get justice and compensation.

Some people put off contacting attorneys because they fear retaliation. We have handled thousands of cases over the last two decades and have never seen a nursing home retaliate against a resident after we became involved, most likely because they know we are watching and will hold them accountable.

Who Can File a Nursing Home Abuse Claim?

If your loved one has physical and mental capacity, they can file a lawsuit. However, we find that the most vulnerable residents are the ones who experience abuse the most. Consequently, many abused nursing home residents are unable to advocate for themselves. In these cases, any interested party, such as a spouse, adult child, sibling, parent, or power of attorney, may file a lawsuit on their behalf. If nursing home abuse leads to death, California Code §377.60 allows the following survivors to file a wrongful death lawsuit:

  • Spouse
  • Domestic partner
  • Adult children
  • Adult grandchildren
  • Legal guardian
  • Personal representative

We are relentlessly committed to safeguarding the rights and dignity of the elderly and have a proven track record of holding nursing homes accountable. We can determine whether you have standing to file a nursing home abuse claim and help you get justice.
