How James Morgan Found His Calling in Elder Abuse Law

James Morgan’s early career was rooted in personal injury law, driven by a desire to help people who had been hurt and needed someone in their corner. Over time, that path led him to a practice area where the need for a skilled and compassionate advocate is greater than almost anywhere else in the legal profession.

James recognized that elderly and dependent adults in nursing homes were among the most vulnerable people in the country. They had placed their trust in facilities that were supposed to protect them. When those facilities failed them, the consequences were often severe. And far too often, the legal system alone was not enough to ensure those residents got justice. That recognition shaped everything that followed.

“After law school I worked for a federal judge for a couple of years and I got to see a lot of trials. I got to see a lot of attorneys helping people in employment law situations or labor law situations. Those inspired me but I really was drawn to do some kind of personal injury, to help people who are really injured and really whatever the injury was, it really affected their lives, so I started looking for those types of opportunities. I met a couple of guys who did elder abuse in California and I thought I could really get into helping elders who have been neglected and abused. So I talked to them, they offered me a job and I've been doing this for 26 years.”

What It Means to Represent Families During Their Most Difficult Moments

During his conversation with host Andrew Samalin, James spoke candidly about the emotional reality of elder abuse litigation. When a family discovers that a loved one has been harmed in a facility that was being paid to provide care, the pain is profound. There is grief, anger, guilt, and confusion. Families often feel they should have seen the signs sooner or acted faster.

James described the importance of meeting families where they are. The first conversation with a potential client is not just about gathering facts. It is about listening. It is about acknowledging what the family has been through and earning their trust at a moment when trust has already been broken. At Lanzone Morgan, LLP, the faith that clients place in the firm is never taken lightly. Every attorney and every member of the support team approaches each case with the empathy and compassion they would bring to a member of their own family.

Patient Rights in Long-Term Care Facilities

A key part of James’s discussion on Lawyers Who Care focused on the legal rights that nursing home residents hold and how regularly those rights are violated. Every resident in a care facility is entitled to dignity, safety, proper medical treatment, and protection from abuse and neglect. These protections exist under both federal and California state law.

Violations can take many forms. Residents may suffer falls, broken bones, subdural hematomas, infections, bedsores, sexual assault, dehydration, malnutrition, poor hygiene, overmedication, wandering and elopement, or wrongful death. Many of these outcomes are preventable. When they occur because a facility failed to meet its duty of care, families have and should explore legal options.

When Litigation Becomes the Only Path to Accountability

James was direct on the podcast about what happens when a facility refuses to accept responsibility. Discussion covered how nursing home corporations are not small operations. They are backed by experienced defense teams and insurers whose job is to minimize liability. Attempts to resolve cases outside of court are not always met with good faith. When that happens, litigation is not just an option. It is the only path to accountability. Lanzone Morgan, LLP is built for that reality. The firm’s attorneys are experienced trial attorneys who are not intimidated by the courtroom. Nursing home corporations know Lanzone Morgan, LLP. That reputation matters. It creates pressure on facilities that might otherwise refuse to engage honestly.

A Case That Could Not Be Ignored

James also shared details of a case that illustrates what is at stake when a nursing home abandons its duty of care. A nursing home resident was not transported to critical cancer treatments. These were appointments that directly affected the resident’s survival and quality of life. The resident also developed a serious bedsore. The wound was a direct result of the facility’s failure to provide attentive, basic care.

This was not a single oversight. It was a pattern of neglect. The facility was being paid to protect this person. Instead, they failed to meet even the most fundamental obligations. For the family, watching a loved one deteriorate under the care of a facility that was supposed to help them was a devastating experience. It was also one that demanded a legal response.

The Jury's Decision and What It Meant for the Family

Despite the weight of the evidence, the nursing home refused to take responsibility. The case went to trial. The jury reviewed the facts and returned a verdict that was unambiguous. They found over 1,400 violations of the resident’s rights and awarded $7.6 million in damages.

As James reflected on the episode, what mattered most to the family was not only the dollar amount. It was the acknowledgment. A jury of their peers heard what happened to their loved one and decided it was wrong. They decided the facility was responsible. That kind of validation is something no settlement can fully replicate. It is also a message to the long-term care industry that this level of neglect carries real consequences.

Why Families Must Advocate for Their Loved Ones

One of the most powerful points James made throughout the podcast was a direct call to families. When a loved one is in a care facility, family members are their most important advocates. Elderly and dependent adults are often unable to report abuse or neglect on their own. Cognitive decline, physical limitations, and fear of retaliation can all prevent a resident from speaking up.

Silence does not mean nothing is wrong. James encouraged families to pay close attention during every visit. Document changes in physical condition. Note unexplained injuries or sudden weight loss. Ask questions when something does not add up. If something feels wrong, act on that feeling and contact Lanzone Morgan, LLP for a free consultation. The most vulnerable people deserve the most determined advocates.
