Rampant Nursing Home Abuse in San Diego Nursing Homes

Among the 81 nursing homes in San Diego County, 14 are rated below average or much below average, and six have been flagged for nursing home abuse. The Centers for Medicare and Medicaid Services provides these ratings based on state inspection results. State inspectors are required to perform inspections annually and in response to complaints. Inspectors found multiple instances of severe neglect and abuse in San Diego nursing homes in 2024, including the following:

  • A resident in Lemon Grove Care and Rehabilitation Center with a known history of violent behavior wandered the facility unsupervised, entered other residents’ rooms, and yelled, cussed at, pulled hair, slapped, and hit other residents on numerous occasions.
  • A CNA at Brighton Place of San Diego reportedly pulled off a resident’s clothes and pushed her against the side rails of her bed. The facility had hired the CNA without performing the required reference checks.
  • A resident of San Diego Post Acute Center with cognitive impairment eloped unnoticed and suffered a fatal injury from being struck by a pickup truck.

Lack of Oversight Leads to Repeated Abuse in San Diego Nursing Homes

A KPBS investigation found that officials are not taking nursing home abuse complaints in San Diego nursing homes seriously. For example, Avocado Post Acute in El Cajon received over 620 complaints from 2019 to 2022, four times the state average for facilities of its size. Investigators substantiated cases of physical abuse, sexual assaults, and even a resident-to-resident homicide in the facility, yet Federal regulators failed to shut down the facility. Today, the facility operates under the new name Stillwater Post Acute.

A resident of Avocado Post-Acute reported being sexually assaulted by a CNA in 2019, but the facility claimed she only reported that he had handled her roughly. Despite telling state investigators that she reported the sexual assault right away, investigators believed the nursing home. The California Department of Health allowed the CNA to keep working. He sexually assaulted at least two other women in two other area nursing homes. Ultimately, he was criminally charged and convicted for one of the assaults, and he pleaded guilty to the other two.

How Long Do I Have to File a Nursing Home Abuse Claim?

Under the California medical malpractice statute of limitations, you must file your nursing home abuse lawsuit within three years of the abuse or one year of the date you discovered the injuries, whichever comes first. If the nursing home covers up the abuse through fraud or intentional concealment, the deadline may be extended. It is crucial to contact us immediately to protect your case.
