So there’s a number of parties that can be held liable in a nursing home abuse case. First and foremost is the nursing home themsel. They’re responsible for the care of their residents. So if a resident is abused or neglected in their care, they are first and foremost responsible. Additionally, a lot of nursing homes have management companies or ownership companies. These companies are also responsible because they control the operations of the nursing home, thus allowing the abuse and neglect to occur. Additionally, sometimes individual caregivers such as nurses and certified nursing aids can be held liable if they acted outside the scope of their employment at the nursing home.
