Why Families Trust Our Walnut Creek Nursing Home Abuse Lawyers
As one of the leading elder abuse law firms in the U.S., we’ve recovered over $250 million for clients harmed by preventable care failures. Three of our attorneys were recently recognized as Top 10 Nursing Home Trial Lawyers, placing them in an elite group honored for their work in nursing home litigation.
With each case, we seek to hold a negligent facility accountable while sending a broader message that mistreating vulnerable residents has serious consequences. By fighting nursing home abuse, we aim to discourage profit-driven neglect and improve care throughout California.
Our work has also helped to strengthen protections for older adults. In 2026, we secured a landmark appellate decision confirming that certain elder neglect claims are not subject to California’s medical malpractice damages cap. This ruling allows families to secure greater compensation on behalf of loved ones harmed by nursing home abuse and neglect.
We’re Singularly Focused on Fighting Nursing Home Abuse
Nursing home abuse cases involve a complex framework of care standards, state and federal regulations, and corporate entities. Because this area of the law is all we do, we know how to uncover what went wrong in a resident’s care and trace responsibility through a facility’s corporate structure.
Founding attorneys James Morgan and Anthony Lanzone built our firm with a sole mission to protect the rights and welfare of the elderly community. This singular focus means we’re ready to take immediate action when you turn to us with concerns about a loved one’s care. We don’t back down when negligent facilities and their insurers deny responsibility, and our trial-ready nursing home neglect lawyers will explore every legal avenue to push for fair compensation.

Trust Your Instincts When Something Feels Wrong
Families often sense that something is wrong before they understand the full extent of a nursing home’s failures. Bedsores that develop and worsen or repeated falls leading to fractures may raise concerns. However, less noticeable issues may also arise. Poor hygiene may result from inadequate care. Dehydration or malnutrition may cause gradual weight loss. An infection may remain untreated until it progresses to sepsis. Without prompt action, these issues can lead to life-altering injuries or contribute to wrongful death.
If anything feels wrong, trust your instincts. However, you don’t need to blame yourself if you didn’t recognize the signs immediately. The facility’s failure to provide appropriate care is not your fault, and our nursing home abuse lawyers are ready to help. When you choose us to represent you, we’ll listen carefully, communicate openly, and treat your family with care as we pursue accountability on your behalf.
Compensation Available in a Nursing Home Abuse Claim
Financial compensation cannot undo the harm caused by a nursing home’s negligence, but it can address the losses your family has suffered. Depending on the circumstances, available damages in a nursing home abuse claim may include:
- Past and future medical expenses
- The cost of moving to a safer facility
- Physical pain and suffering
- Emotional distress
- Loss of enjoyment of life
- Funeral and burial expenses
- Loss of companionship or parental guidance
- Loss of financial support
Hiring a firm with proven results can make a meaningful difference in your family’s ability to move forward after serious care failures cause preventable harm.
Our notable nursing home abuse settlements and verdicts include $3 million for a dependent adult who developed an infected bedsore, $2.3 million for an elderly individual who broke several bones after multiple falls at a skilled nursing facility, and $1.2 million for the family of a man who starved to death because of nursing home neglect.
Case Highlight: Neglected Bedsore Leads to Resident’s Death
On December 13, 2021, a resident entered a skilled nursing facility with an existing pressure sore on her coccyx. She required extensive help with repositioning and experienced frequent incontinence, which placed the wound at high risk of contamination. Over the next two weeks, staff repeatedly failed to perform ordered skin checks, wound treatments, and repositioning. By December 25, the wound had enlarged and showed signs of infection, and the resident appeared increasingly frail.
When the facility finally transferred the woman to the hospital on December 29, doctors diagnosed a stage IV pressure sore, necrotizing fasciitis, and septic shock. She died on January 13, 2022. Using records from the facility and the hospital, our nursing home negligence attorneys reconstructed this progression of events to argue that the resident’s rapid decline resulted from missed or delayed interventions. Thus, we secured a significant settlement for the woman’s family.
How Our Attorneys Can Help With Your Abuse or Neglect Case
Proving nursing home abuse or neglect can be challenging, even when it seems obvious that something has gone very wrong. The facility controls much of the evidence, allowing it to devise its version of events before your family has access to the records needed to challenge it.
When you contact our elder abuse lawyers in Walnut Creek, we’ll step in quickly to obtain critical evidence and level the playing field. We can obtain and analyze medical records, care plans, incident reports, staffing and training records, surveillance footage, and other documentation to reconstruct the events surrounding your loved one’s care. We may also consult independent medical experts to determine what care your loved one should have received and whether appropriate care could have prevented their injuries.
Once we build your nursing home abuse claim, we’ll negotiate with the facility’s insurance company for a fair settlement. If those negotiations are unsuccessful, we’ll be ready to take your case to trial and present the evidence to a jury.
Steps to Take if You Suspect Nursing Home Abuse in Walnut Creek
If you suspect your loved one is suffering abuse or neglect in a Walnut Creek nursing home, you can play a powerful role in protecting them from further harm.
Start by addressing your loved one’s immediate medical needs. If they appear to be in danger, call 911. Otherwise, request a prompt medical evaluation.
Be sure to gather evidence of your concerns. Photograph visible injuries or dangerous living conditions and keep notes about your observations. Notify the facility’s administrators in writing, and hold on to copies of any written communication.
Once you’ve taken those initial steps, you can then contact the appropriate state resources. If you have a complaint against a nursing home, call the California Department of Public Health at (800) 554-0354. To report abuse or neglect currently happening in a nursing home or assisted living facility, call the California Department of Aging Long-Term Care Ombudsman CRISIS Line at (800) 231-4024.
Patterns of Care Failures in Walnut Creek Nursing Homes
Contra Costa County inspection reports reveal concerning patterns across local nursing homes. All of the county’s 30 nursing homes have received citations for infection-related deficiencies, and two were cited for serious deficiencies.
Collectively, facilities in the county have incurred $311,000 in penalties. Regulators have also imposed three payment suspensions, meaning the facilities temporarily stopped receiving certain Medicare or Medicaid payments until they corrected serious deficiencies.
Inspection reports provide a closer look at the care failures behind these broader trends. Recent findings from Walnut Creek nursing home facilities show how violations can expose residents to preventable harm.
Walnut Creek Skilled Nursing & Rehabilitation Center
In a May 2024 inspection report, surveyors noted that Walnut Creek Skilled Nursing & Rehabilitation Center delayed CPR for a resident whose medical orders required resuscitation. Other staff eventually started CPR, but emergency personnel pronounced the resident dead 42 minutes after they had been found with no pulse.
Tampico Healthcare Center
A March 2025 health inspection found that Tampico Healthcare Center repeatedly failed to respond to residents’ dangerously high blood pressure. One resident had readings as high as 198/94 without receiving proper interventions or follow-up care. Another resident had five elevated readings, but the staff did not notify the doctor. The nursing director reportedly acknowledged that the failures could lead to a stroke.
Surveyors also observed a severely cognitively impaired resident receiving tube feeding with the head of her bed below the ordered 30-degree minimum. On one occasion, an aide left her lying flat while the feeding continued, which created a risk that she could inhale stomach contents into her lungs.
Rossmoor Post Acute
According to a January 2025 complaint inspection report, staff members at Rossmoor Post Acute lost control of a resident while turning her during after-shower care, causing her to fall face-first from the bed. The resident struck her head, briefly lost consciousness, and sustained an ankle contusion and a large forehead laceration. Surveyors concluded that the facility failed to provide adequate supervision and safety measures during the resident’s care, but the facility disputed the citation.
Tice Valley Post Acute
A January 2025 inspection determined that Tice Valley Post Acute failed to provide adequate assistance and supervision for a dependent resident’s incontinence care. The resident reportedly slipped from the bed and fell between the bed and nearby furniture, resulting in a fractured shoulder and leg laceration that required 15 stitches.
La Casa Via Transitional Care Center
During a June 2025 inspection, surveyors found that La Casa Via Transitional Care Center administered 30 doses of Depakote, a mood-stabilizing medication, to the wrong resident over a two-week period. Surveyors also found insulin pens missing open and discard dates, which created a risk that residents could receive insulin with reduced effectiveness.
You Deserve the Truth About Your Loved One’s Care
Few things are more unsettling than knowing something went wrong with your loved one’s care but not receiving the full truth. The facility you trusted to meet your vulnerable loved one’s needs may provide vague answers to your questions, offer conflicting accounts of what happened, limit visitation, or ignore you altogether.
Being kept in the dark only adds to the sense of injustice you might be feeling, and you do not have to keep pressing for answers on your own. Walnut Creek nursing home abuse lawyers at Lanzone Morgan, LLP, can uncover the care failures that may have caused your loved one harm and pursue the accountability your family deserves.
