Between 2004 and 2014, the number of nursing home abuse cases reported to the Orange County Elder and Dependent Adult Abuse Registry increased by 74%. This increase reflects a painful reality—far too many seniors suffer in silence. These cases often stem from deep, systemic failures in care.

“There are five most common types of injuries that I see because of elder abuse and neglect. Number one is pressure sores. We see pressure sores all the time in nursing home cases, because the residents, especially the ones who are bed-bound, are not turned and repositioned or gotten out of bed enough, so they develop pressure sores commonly on their heels or their coccyx or backside. The number two type of injury we see from neglect in a nursing home is what we call the fall fracture case. This is when the elderly person falls in the facility because they have a high fall risk. Maybe they hit their call light and nobody comes to help them right away, they get up and try to go to the bathroom, they fall, and they have an injury... I'd say number three, probably infections. Commonly, we see urinary tract infections. The reason we see urinary tract infections so often is that elderly people who cannot get up and go to the bathroom by themselves end up going to the bathroom while they're lying in bed in a diaper or just in their sheets. And if there's not enough staff in the nursing home, they sit in their urine or feces for extended periods of time, and of course, they end up getting a urinary tract infection. Number four would be dehydration and malnutrition. This happens when the elderly person can't feed themselves, or maybe they don't have the dexterity to pour themselves a glass of water. They certainly can't get up to get a glass of water, and sometimes the nursing home is short-staffed and doesn't have enough people walking around to get them water, or help them drink the water... And number five, we call it overmedication, or chemical restraints. We've seen nursing homes where they don't want the residents yelling all the time or hitting the call lights all the time. They really just want them to lie in bed and not be much of a bother to the staff. So they overmedicate them. It's very common for me to get calls from the children of people who are in nursing homes, and they say mom or dad was fine and very communicative when they went into the nursing home, but now they are groggy. They sleep 20 hours a day. Every time I go in, I can barely wake them up. Well, that's possibly because they're overmedicated, or the nursing home possibly is using medications as a chemical restraint to keep the elderly person from needing as much help.”

Time Limits for Filing a Nursing Home Abuse Claim

The statute of limitations for nursing home abuse claims is complex because many case-specific circumstances affect it. For example, if the case is against a governmental entity, a notice of claim must be filed within six months of the injury. If the case involves substandard medical care or negligence on the part of a licensed healthcare provider, the statute of limitations is generally one year from the discovery of the injury, but no more than three years from the incident.

If someone other than a licensed health care provider committed the neglect or abuse, the case may be governed by the standard personal injury statute of limitations, which is generally two years from the date of the incident. If the case involves financial abuse, the statute of limitations may be as long as four years. Another thing to consider is whether the victim had the mental capacity to bring a lawsuit. If the victim is mentally incapacitated, the statutes of limitations mentioned above may be tolled, and there may be additional time to bring a claim.
