The jurors found the facility guilty of a record-breaking 1,437 violations of the California Nursing Home Residents’ Bill of Rights, which contributed to the substantial verdict.

Recent Elder Abuse Allegations Involving Oakland Elder Care Facilities

Some of the most alarming local allegations of elder abuse and neglect in recent years involve Windsor Healthcare Center of Oakland. In March 2024, a lawsuit alleged that a 79-year-old woman with cognitive impairments was sexually assaulted multiple times by another resident at the facility. The complaint claims that several employees were aware of the abuse but failed to act. 

In July 2024, a separate wrongful death lawsuit against the facility alleged that staff administered a heavy regimen of medication to a 64-year-old resident to prevent him from wandering. According to the complaint, staff allegedly did not consult the physician responsible for approving each dose. The drugs were later linked to the man’s death, the lawsuit alleged. 

Oakland Heights, another local nursing home facility, has also faced legal action for allegations of neglecting a bed-bound 85-year-old resident in 2022. According to the resident’s family, staff repeatedly ignored her calls for help and allowed her to develop bedsores.
