When a care facility fails to protect an elderly resident, the consequences can include painful injuries, declining health, and even death. Families may be left searching for answers after the facility minimizes what happened or fails to explain a sudden change in their loved one’s condition.
Our Fresno nursing home abuse lawyers take those concerns seriously. We investigate the care your loved one received, explain your family’s legal options, and fight to hold responsible facilities accountable. Throughout the process, we listen, communicate clearly, and provide the compassionate support your family deserves.
Why Families Trust Our Fresno Elder Abuse Lawyers
Families with loved ones who have been neglected or abused in nursing homes need more than assurances. They need attorneys with the experience, results, and compassion to confront powerful care corporations. At Lanzone Morgan, LLP, we have 75 years of combined experience and have recovered over $250 million for neglect and abuse victims and their families.
Our exclusive focus is on safeguarding the rights and dignity of the elderly. We fight nursing home abuse to obtain justice for each family affected by elder abuse and seek systemic changes that protect all older Californians. Recently, we won a landmark California appellate decision finding that damages caps don’t apply in certain elder abuse claims against nursing homes, allowing abuse victims to recover much more compensation than before. Our attorneys also secured a $2.3 million jury award recognized as California’s No. 1 verdict for that year in the elder abuse and related categories.
Our track record has earned us a reputation for providing a voice for the voiceless. Firm founders James M. Morgan and Anthony C. Lanzone and associate attorney Elizabeth Kim have been named among the Top 10 Nursing Home Trial Lawyers in 2026.
We do not take the faith that our clients put in us lightly. So we are committed to providing outstanding customer service. We listen, communicate clearly, and treat every client like family. Our goal is to protect each resident’s dignity and give families a strong voice against facilities that failed them. Past results do not guarantee future outcomes.

Signs You May Have an Elder Abuse or Neglect Case in Fresno
Not every injury results from abuse or neglect. A potential claim may exist when a facility or caregiver fails to provide needed care and causes or worsens harm. California law defines neglect as the failure to provide the degree of care that a reasonable person in a like position would exercise. These failures may involve hygiene, medical care, safety, nutrition, or hydration.
Sadly, neglect and abuse occur far too often in nursing homes. A World Health Organization review found that nearly two-thirds of staff studied in institutional settings reported committing some form of abuse in the previous year.
Warning signs to watch for include the following:
- Repeated falls, fractures, head injuries, or unexplained bruising
- Bedsores, infections, or delayed medical care
- Dehydration, malnutrition, or rapid weight loss
- Poor hygiene or unclean bedding
- Overmedication, unusual sedation, or improper restraints
- Wandering, elopement, sexual assault, or an unexpected death
Trust Your Concerns About Your Loved One’s Care
Families do not always recognize abuse or neglect until a serious injury or hospitalization occurs. A bruise may have seemed minor, or staff may have offered an explanation that appeared reasonable at the time. Not seeing the full picture sooner does not make the harm your fault. You trusted the facility to protect someone you love.
If something about your loved one’s care still does not feel right, trust your gut and contact us. Our attorneys will listen, investigate what happened, and fight for your loved one’s right to safe, dignified care
"The people we represent are at a stage in their lives where they’re vulnerable. They’ve been injured, and they’ve been injured by someone they trusted. Our job is to make sure they’re protected, that they’re taken care of, and that the people who hurt them are held accountable."

Compensation Available in a Fresno Elder Abuse Case
In general, you can pursue compensation for medical expenses, relocation costs, lost income, pain and suffering, or funeral expenses. If a court finds the defendant’s conduct was reckless, malicious, oppressive, or fraudulent, the remedies may include attorneys’ fees, costs, and punitive damages.
If your loved one has died from neglect or abuse at a Fresno nursing home, our team can also help you seek funeral expenses, loss of companionship, loss of inheritance, and other wrongful death damages.
Families deserve evidence that the law firm they hire can take on powerful care facilities and see a difficult case through to the end. We have a long record of securing meaningful results for our clients, such as the following verdicts and settlements:
- $7.6 million verdict: Awarded after a jury found the nursing home liable for neglect of an elderly veteran in the largest Bill of Rights verdict in California history, with 1,437 violations
- $2.3 million verdict: Awarded to a resident who had repeated falls, resulting in a broken arm and pelvis
- $3 million settlement: Negotiated for a dependent adult who developed an infected bedsore
Case Highlight: Exposing Repeated Failures in a Fresno County Facility
In a recent Fresno County case, a nursing home admitted a resident with a Stage 3 pressure sore and a care plan that called for frequent repositioning. However, the staff missed more than 100 scheduled turns. The wound progressed to Stage 4, and the resident developed sepsis, pneumonia, and a colon infection, leading to her death.
After reviewing the care plan and facility records, our attorneys filed suit and argued that each failure to follow proper repositioning protocol was a separate violation of the resident’s rights. We secured a significant settlement for the resident’s family.
How Our Fresno Elder Abuse Lawyers Help Your Family
If you are worried about the care a loved one is receiving at a nursing home, you may receive changing explanations, incomplete details, or claims that the injury was unavoidable. A Fresno elder abuse lawyer can look beyond those explanations and help determine what happened. Our legal team can do the following for you:
- Obtain and review care plans, medical charts, incident reports, photos, video, and staffing records
- Consult with medical professionals to trace how an injury developed and whether it could have been prevented
- Identify the facilities, management companies, staff members, or owners that are responsible
- Address immediate safety concerns and report ongoing harm
- Handle communications with the opposition and keep your family informed
- Evaluate the losses and pursue compensation through settlement negotiations and litigation
- Take your case to trial, if necessary, and advocate for your family’s best interests
Families often contact us after trying to get answers on their own. We listen to what you have seen, explain the legal process in plain language, and take on the work of building the case.
Your Loved One’s Rights in a California Care Facility
Residents do not surrender their rights when they enter a care facility. Under 42 C.F.R. § 483.10, nursing home residents have rights to dignity, equal access to quality care, participation in care planning, access to records, and freedom from physical or chemical restraints used for discipline or convenience.
California provides additional protections based on the type of facility. California Health and Safety Code § 1599.1 requires skilled nursing and intermediate care facilities to employ adequate qualified staff, help prevent bedsores, provide adequate food, maintain sanitary surroundings, and keep call systems working. California Health and Safety Code § 1569.269 gives residents of residential care facilities for the elderly rights to care and supervision that meet their individual needs and freedom from abuse, neglect, coercion, and retaliation.
Elder abuse and neglect litigation is the focus of our practice. We use our knowledge of these protections to identify violations, explain your loved one’s rights, and build the case.
Recent Deficiencies at Fresno Nursing Homes
Public inspection records can help families identify care failures that may warrant further investigation. ProPublica’s Nursing Home Inspect database, which compiles federal inspection data, reports the following recent findings at Fresno facilities. A deficiency alone does not prove elder abuse or neglect, but it may provide important context when a resident suffers harm.
Healthcare Centre of Fresno
During a May 2026 inspection, Healthcare Centre of Fresno received 10 deficiencies. Inspectors cited failures involving significant medication errors, incomplete care plans, accident hazards, and inadequate supervision. The findings reflected the potential for more than minimal harm.
Horizon Health & Subacute Center
A March 2026 complaint report cited Horizon Health & Subacute Center for failing to provide enough nursing staff to meet residents’ needs. Inspectors also cited the facility for failing to ensure nurses and aides had the necessary competencies to care for residents.
Oakwood Gardens Care Center
A January 2026 complaint report cited Oakwood Gardens Care Center for failing to provide adequate supervision and maintain an environment free of accident hazards. If your loved one was harmed under similar circumstances, contact us so we can review the records and determine whether the facility’s failures support a claim.
