Justice Secured After Resident’s Fall Injuries Lead to Death

Fall Injuries at Assisted Living Facility Lead to Resident’s Decline and Death

In April 2024, our team sent a letter to an assisted living facility on behalf of the estate of our client, alleging that abuse and neglect at the nursing home contributed to her decline and death.

Our client was admitted to the assisted living facility in July 2020 with a dementia diagnosis and a history of falls. By 2023, she began to show signs of increased confusion and had her first fall that May, suffering a wrist fracture. Though she needed extra assistance and supervision with most daily tasks at that point, the facility still considered her able to walk and transfer to and from her walker independently. 

Our client suffered three additional falls that June before being moved to memory care, but the facility still considered her independent, allowing her to shower and use the toilet unassisted. Our client’s daughter attempted to hire outside help out of concern for her level of care, but the facility would not allow third parties inside its memory care unit.

The Victim Deteriorated Quickly After a Major Fall

In October 2023, paramedics found our client on the floor of her room. She was transferred to the emergency room with a right femoral fracture that required surgery. She was dealing with severe pain by the next day and was transferred to a facility with hospice services by the end of the month.

A doctor at the new facility noted that she had declined significantly since the fall, going from having a significant degree of independence to being fully bedridden. She passed away about a week later, on November 4.

After taking up the victim’s case, our team accused the assisted living facility of elder abuse and neglect. The facility knew of our client’s dementia and history of falls, yet failed time and time again to monitor her worsening condition and provide her with the supervision and assistance she needed, ultimately leading to her wrongful death.

Lanzone Morgan Secures Fall Injury Settlement for Victim’s Family

In April 2025, we agreed to resolve our case against the facility through arbitration, with hearings set to begin in September. The arbitration sided with us, awarding significant compensation to the family.

“Oftentimes, the nursing home can be very vague about the facts of the fall. I would be persistent and ask everybody I could about the circumstances of the fall. If you're not getting straight answers, then I want to investigate because something fishy is going on. Also, if there's a fall in a nursing home, I want to know: Was it witnessed? Did somebody see the fall? Because a lot of times, I'll get a report that the nurse walked by the room and saw the elder on the floor. Maybe the nurses didn't witness the fall, but the roommates or the roommate's family witnessed the fall. And a lot of times I'll get a report from the roommates or the family of the roommates that the elder fell, and they were on the floor for 10 minutes or 20 minutes before anybody came.”
