Patients’ Rights in Arizona Long-Term Care Facilities

A nursing home should be a safe, home-like environment where your loved one enjoys a dignified existence. The United States Nursing Home Reform Act, U.S. Code of Federal Regulations §483.10, and Arizona Administrative Code § R9-10-2211 give nursing home residents the following rights:

Widespread Nursing Home Abuse in Arizona

Adult Protective Services in Arizona reports having received 37,305 elder abuse allegations in 2023. The Arizona Department of Health Services is responsible for investigating nursing home abuse and neglect, but it has received criticism for failing to investigate abuse allegations in a timely manner.

In 2024, Governor Katie Hobbs signed H.B. 2764 into law. The measure requires certification for nursing homes and assisted living facilities that provide enhanced memory care services. It also enhances oversight and raises the maximum penalty for violations of health and safety regulations.

While we applaud these measures, they do not go far enough to curtail elder and dependent adult abuse in the state. Horrific stories about abuse in Arizona nursing homes, assisted living facilities, and care facilities continue to make the headlines.

Recent Headlines About Arizona Elder and Dependent Adult Abuse

Fatal Bedsores from Nursing Home Negligence

According to an AZ Central report, a resident with dementia was found face-down at Sun West Choice Health and Rehab in Sun City West with a horrific bedsore. Ensign Group, which owns this facility and approximately 30 percent of all Arizona nursing homes, has a history of understaffing, which puts residents at risk of abuse and neglect. It also uses arbitration agreements with secrecy clauses. Attorney General Kris Mayes is suing to ban such clauses, having prevailed in similar cases.

Felony Sexual Assault in an Assisted Living Facility

Fox 10 Phoenix reported that Gabriel Garcia, a former medication technician at Scottsdale Village Square, was arrested for felony sexual assault and emotional abuse of a resident with Alzheimer’s. The charges came after the victim’s son observed the abuse on video. The Maricopa County Sheriff’s Office is also investigating Garcia for sexually abusing residents at Fountain Hills Post Acute.

Sexual Assault of a Dependent Adult and Care Facility Negligence

A nurse received a 10-year prison sentence in 2021 for sexually assaulting a resident at Hacienda HealthCare, an intermediate care facility for adults with intellectual disabilities. The victim, who has severe cognitive, motor, and vision impairments, became pregnant with the attacker’s child, but the facility failed to notice until she gave birth. Staff had reduced her feeding tube intake in response to weight gain, so she gave birth dehydrated. The family sued and won settlements from the state and the doctor totaling $22.5 million. The facility has since closed its doors.

Health and Safety Violations at Arizona Nursing Homes

In the last year alone, nine of Arizona’s 141 Medicare-certified nursing homes received citations for serious deficiencies. Twenty-three have been cited for abuse-related deficiencies during the last year. Six had deficiencies serious enough to result in payment suspensions, and 106 received citations for infection-related deficiencies.

Rehab at Scottsdale Village Square

Rehab at Scottsdale Village Square has a red hand icon next to its name on Medicare’s website, indicating that it is one of the 23 Arizona nursing homes recently cited for abuse. Recent inspection results show that Rehab at Scottsdale Village Square has failed to effectively manage resident behavior to protect their safety. Inspectors found multiple instances of residents with dementia wandering off the grounds of the facility and becoming lost in the community. This facility has also failed to protect residents from violent attacks by other residents.

On August 1, 2024, state inspectors identified conditions of “Immediate Jeopardy” and “Substandard Quality of Care” after finding that the facility failed to protect a resident with dementia from sexual and physical abuse by staff or investigate it. The facility also allowed the perpetrator to continue working there. 

Winslow Campus of Care

State inspectors cited Winslow Campus of Care for putting residents in immediate jeopardy and providing substandard care in October 2024 when staff failed to offer life-saving measures to an unresponsive resident. Staff told inspectors that a nurse found the resident not breathing and without a pulse. The resident was a full code, but the nurse failed to attempt CPR or call emergency medical services. The resident died.

In the last three years, this facility has had 51 complaint inspections resulting in citations. Many of these complaints are related to resident-on-resident violence. Winslow Campus of Care received citations on the following dates for failing to prevent residents with known aggressive tendencies from attacking others:

  • March 3, 2025
  • February 20, 2025
  • January 31, 2025
  • October 25, 2024

Sierra Winds

In a January 2024 inspection, inspectors found that Sierra Winds in Peoria put residents in immediate jeopardy and provided substandard care. The facility received a citation for failing to ensure the facility was free of hazards and failing to provide adequate supervision to prevent accidents. According to the report, inspectors found dangerous water temperatures exceeding 120 degrees Fahrenheit in 17 resident rooms, which could have caused serious burn injuries. The facility also failed to prevent a resident from falling and suffering a fracture.

In March 2023, inspectors learned through a review of a resident’s records that the facility failed to prevent a bedsore and allowed it to progress.

Life Care Center of Paradise Valley

Life Care Centers of America is one of the largest nursing home operators in the nation, with more than 220 facilities across the country. It is notorious for understaffing and negligence. This wealthy corporation owns Life Care Center of Paradise Valley, located in Phoenix, which has had 11 health citations in the last year and 24 complaints in the last three years that resulted in citations. 

Citations against Life Care Center of Paradise Valley include the following:

  • Failure to prevent bedsores from developing and worsening due to insufficient staff 
  • Failure to provide appropriate respiratory care to a resident with advanced chronic obstructive pulmonary disorder
  • Failure to protect a resident from verbal abuse and threats of violence by a fellow resident with a known history of aggressive behavior
  • Failure to protect residents from all forms of abuse and report it in a timely manner

Life Care Center of Tucson

Life Care Center of Tucson has received 10 citations in the past year, and five complaints in the last three years have resulted in citations. This facility had a power outage just before its health inspection on July 17, 2024. Inspectors found that the facility was unprepared. The report states that the facility’s emergency backup systems were non-operational. Emergency lights, fire suppression equipment, and alarms were not functional. Resident rooms were hot, with wall temperatures exceeding 87 degrees Fahrenheit.

Life Care Center of Tucson has also received citations for unsafe building conditions. Food was stored at unsafe temperatures, and building maintenance was dismal. Inspectors also found the following:

  • A missing doorframe
  • Peeling paint
  • Multiple sharp gouges on handrails throughout the facility.

In addition, this facility failed to provide staff training in abuse, resident rights, infection control, dementia training, and emergency preparedness.

Palm Valley Post Acute

In November 2023, state inspectors discovered that Palm Valley Post Acute in Goodyear failed to investigate and timely report allegations of ongoing sexual abuse of a resident by a CNA. According to the inspection report, the facility covered it up, intimidated anyone who attempted to report it, and allowed the alleged perpetrator to continue working until state inspectors forced the facility to terminate him.

The resident told inspectors the CNA raped her 15-20 times. She stated that when she tried to report the rape, the operations director told her to follow the chain of command and refused to speak to her. A male resident told inspectors he was present when this occurred and that he helped her report the assaults to the police. The victim also told inspectors that the facility kept discharging residents who reported the rapes.

Palm Valley Post Acute has received 27 citations in the last 12 months and 23 complaints resulting in citations.

Special Focus Facilities in Arizona

A Special Focus Facility is a nursing home selected by the Department of Health Services for heightened supervision due to a longstanding history of deficiencies and quality concerns. The Centers for Medicare & Medicaid Services monitor these facilities with heightened supervision and enforcement.

Palm Valley Post Acute in Goodyear is currently Arizona’s only Special Focus Facility. The Department of Health Services selects facilities from the candidates’ list to become Special Focus Facilities based on a point system based on the number of deficiencies and their severity. Selected facilities become candidates and may become Special Focus Facilities as slots become open. Special Focus Facilities can lose their Medicare certification if they fail to improve. The following nursing homes in Arizona are on the Special Focus Facility candidate list:

Is There a Time Limit for Filing an Arizona Nursing Home Abuse Claim?

Under Arizona’s statute of limitations, nursing home abuse claims generally must be filed within two years of the incident date. If the harm is not immediately apparent, the case must be filed within two years of when the abuse is or reasonably should have been discovered.
