Something felt wrong, and you didn’t imagine it. Maybe it was a bruise nobody could explain, or a phone call that never got returned. If you have a loved one in a Solano County nursing home and your gut is telling you to look closer, that’s reason enough to call Lanzone Morgan, LLP.

Why Solano County Families Trust Our Nursing Home Abuse Attorneys

The people who reach out to us are rarely the residents themselves. They are sons and daughters, husbands and wives, siblings who trusted a facility to protect someone they love and are now trying to piece together what actually happened. If that describes you, you are in the right place.

We do not practice several areas of law. Elder abuse cases are all we handle. With over 75 years of combined experience, Lanzone Morgan, LLP, has recovered more than $250 million for victims of nursing home abuse and neglect across California. We are recognized as one of the leading elder abuse law firms in the country, and nursing home corporations statewide know our name.

Founding partners James Morgan and Anthony Lanzone built this firm on a simple belief: there is no greater cause for a lawyer than standing up for someone who cannot stand up for themselves.

Your family member deserves justice even if the abuse or neglect only happened once. The level of harm or the number of incidents does not matter to us. We will fight to hold the facility accountable no matter what.

"There has been no greater reward than serving as a nursing home abuse attorney, being the voice and advocate for the thousands of clients I have represented over the many years of practice, and holding the perpetrators accountable. Vulnerable victims are often cast aside by society. There is no greater cause as a lawyer than fighting for them."

What Compensation Can Your Family Recover?

Families affected by nursing home abuse or neglect in Solano County may be entitled to substantial compensation. Our attorneys pursue every category of damages the law allows, which can include:

  • Personal Injury Damages: Past and future medical expenses tied to the abuse or neglect, the cost of moving your loved one to a safer facility, physical pain and suffering, emotional distress, loss of dignity, and loss of the enjoyment of life
  • Wrongful Death Damages: Funeral and burial costs, loss of companionship, and the pain and suffering your loved one endured before death, if the abuse or neglect proved fatal
  • Punitive Damages: Awarded only when a court finds that a facility acted with malice, oppression, or fraud, meant not to compensate your family but to punish the facility and deter the same conduct against future residents

When Are Punitive Damages Awarded?

Punitive damages are not automatic, and they are not meant to make your family whole. Compensatory damages do that. Punitive damages exist for a different reason entirely: to punish conduct a jury finds especially reckless or malicious, and to send a message to that facility, and every facility like it, that this kind of harm carries a real cost.

In Lanzone Morgan’s $7.6 million verdict for the family of an Air Force veteran, the jury awarded punitive damages after finding the facility liable for more than 1,400 separate violations of the California Nursing Home Residents’ Bill of Rights. The scale of the violations—not just the harm to a single resident—led to the punitive damages award.

Our Solano County nursing home injury attorneys helped that family get answers, accountability, and compensation.

Our Recent Case Results

These results reflect what skilled, committed, and unrelenting advocacy can accomplish. You pay nothing up front when you hire Lanzone Morgan, LLP. We advance all necessary costs to thoroughly investigate and litigate the case, and collect fees only from the compensation we recover. If we do not win, you pay nothing.

How Lanzone Morgan Has Shaped Elder Abuse Law for Every California Nursing Home Resident

Winning individual cases is only part of what we do. Lanzone Morgan, LLP, has also driven changes in the law to protect nursing home residents across California, whether or not they were ever clients here.

The clearest example reached the California Supreme Court. A nursing home had buried a mandatory arbitration clause deep in its admission paperwork, then argued that a family member’s healthcare power of attorney authorized them to sign away the resident’s right to a jury trial. Lanzone Morgan, LLP, took the case all the way to the state’s highest court and won: the Court ruled that a healthcare power of attorney does not carry that authority. Every nursing home resident in California now has that ruling standing between them and the same tactic.

"Here at Lanzone Morgan, LLP, we're very proud of the work we do. Not only do we take on nursing homes and individual cases, but sometimes we have to go to the court of appeals, and we have to go to the California Supreme Court. We have been instrumental in changing the elder abuse laws here in the state of California. We're very proud of that, and we're going to continue to do that as long as we're taking cases."

What Does This Mean for You?

When you hire Lanzone Morgan, LLP, the nursing home’s own defense attorneys usually already know who we are, and that matters more than you might think. Facilities that have lost to this firm before tend to think twice before stalling, hiding behind paperwork, or trying tactics that didn’t work on us the last time. In practice, that often means a better settlement offer and a defense team that shows up to trial already expecting to lose.

The Reality of Nursing Home Abuse in Solano County

The U.S. Department of Justice estimates that around 1 in 10 adults 65 and older experience some form of elder abuse each year. The National Council on Aging puts the number even higher, at closer to 1 in 9, and notes that five additional cases go unreported for every one that reaches the authorities.

"Most of the neglect that we see in our cases stems from understaffing issues. Understaffing occurs when the nursing home tightens its budget to save costs and make more profit...The way to make money by owning a nursing home is to fill every bed so that you can make as much revenue as possible and to take care of those residents with as little labor as possible. Unfortunately, it's also a recipe for neglect of the residents when there's not enough staff to meet their needs."

Solano County, home to Fairfield, Vallejo, Vacaville, and Suisun City, has thousands of residents living in licensed nursing facilities, and understaffing of exactly the kind James Morgan describes shows up again and again in the county’s own inspection records.

Public inspection records from Solano County facilities show a documented pattern of care failures.

Windsor Vallejo Nursing & Rehabilitation Center

CMS gives Windsor Vallejo Nursing & Rehabilitation Center just one star for health inspections, and the facility has paid six fines totaling more than $543,000 over the past three years.

A November 2023 complaint investigation found that the facility caused actual harm to a resident by failing to respond appropriately to an alleged violation and by failing to provide appropriate pressure ulcer care. That same visit led to a 21-day suspension of Medicare payments to the facility. Regulators had already fined the facility $161,100 after a standard inspection in April 2022.

A January 2024 complaint found the facility caused actual harm again, this time by failing to provide one of its residents with basic assistance for daily living. Inspectors cited the facility in November 2023 and January 2024 for failing to report suspected abuse, neglect, or theft to the proper authorities. Nurse turnover at the facility runs 51.5% annually, well above the Solano County and state averages.

Heartwood Avenue Healthcare

A single visit to Heartwood Avenue Healthcare on January 9, 2024, resulted in five citations, two of which were rated as causing actual harm. Inspectors found that the facility failed to provide appropriate pressure ulcer care and prevent new sores from developing, and separately failed to keep the facility free of accident hazards and provide adequate supervision to prevent accidents. The same visit found the facility failed to provide treatment according to physician orders, failed to staff enough nurses to meet residents’ needs, and failed to maintain its infection prevention program. Regulators fined the facility $10,293 the year before, following a February 2023 inspection.

Facilities that cut corners on staffing and assume families won’t check the public records are counting on you not knowing how to fight back. That’s precisely what we are here for. If any of this sounds familiar, call (888) 887-9777 right away. The confidential consultation is free.

Solano County Nursing Home Residents Have Rights

Both Federal and California law protect nursing home residents in Solano County.

Federal regulations grant every resident the right to be treated with dignity and respect, and to live free from abuse, neglect, and exploitation. Beyond that baseline, residents are entitled to:

  • Receive care that promotes independence and quality of life, regardless of their diagnosis or payment source
  • Be free from medically unnecessary physical and chemical restraints
  • Participate in their own care decisions
  • File complaints without fear of retaliation
  • Receive visitors at any hour
  • Manage their personal finances
  • Choose whether they want to keep their belongings

Under California’s Health and Safety Code, nursing homes must employ enough qualified staff and provide residents with proper hygiene care and preventive treatment for bedsores and incontinence. Knowing these protections in detail is part of how our Solano County elder abuse attorneys build a case on your behalf.

""People aren't supposed to get bed sores. People aren't supposed to fall and hit their heads. Especially when the family's trying to do the right thing by entrusting the care and paying thousands of dollars so that this doesn't happen, because they don't have the expertise to take care of them and keep them safe themselves."

What To Do If You Suspect Nursing Home Abuse

If you have reached this point, you are probably carrying a lot of fear, anger, grief, and uncertainty about what comes next. Take these steps one at a time:
  1. Trust what you are seeing. Don’t talk yourself out of a concern because a staff member offered a quick explanation.
  2. Document everything. Write down dates, specific observations, and anything your loved one has said or done that worries you. Take photos if there’s something worth capturing.
  3. Report it. Contact the agencies below, in whichever order fits your situation:
  4. Call our Solano County nursing home abuse lawyers. A free consultation costs you nothing, and it can tell you within minutes whether you have a case worth pursuing.
Every day that passes after an incident like this matters. Records get lost, staff who witnessed something turn over, and the legal window to act narrows. You’ve already done the hardest part. You paid attention and refused to accept an answer that did not feel right. Let us take it from here.

Frequently Asked Questions

Nothing upfront. We handle nursing home abuse cases on a contingency fee basis, advance all investigation and litigation costs, and collect our fees only from the compensation we recover for you. If we do not win, you pay nothing.

Not necessarily, and our firm has direct experience in this area. Lanzone Morgan, LLP, won a case before the California Supreme Court establishing that a healthcare power of attorney does not automatically authorize someone to waive a resident’s right to a jury trial. Arbitration clauses in nursing home admission paperwork are often more limited than facilities want families to believe.

Yes. Relocating your loved one to safer care does not affect your legal right to hold the previous facility accountable for what already happened. In fact, we often recommend it, and the cost of the move itself can be part of what you recover.

You did not create this situation. A facility you trusted to protect your loved one fell short, and now you and your family are the ones left picking up the pieces, researching lawyers, and trying to figure out what to do next. That’s a lot to carry. Luckily, you don’t have to.

Share with us what you know, even if it doesn’t feel like enough. Our attorneys will take it from there: pulling records, identifying what went wrong, and building the case while you focus on your family. Our consultations are always free, and we are available around the clock.
