Case Story: Recovering Compensation for a Wandering Incident

Thinking about a case that involves an elopement or wandering, I think back to one of the first cases I had as an attorney. So, at that time, our client lived at a residential care facility in Los Angeles. Early in the morning, he wandered outside and eventually had a heart attack on the street right outside the facility. Looking at this case, the biggest challenge we encountered was figuring out how he literally walked out of the facility, passed all of the caregivers, and all of the aids without anybody stopping him or asking him if he needed help. What we did to determine that was we took a tour of the facility. And in doing so, we were able to identify the hallways, the exits, and where his room was. Initially, we realized his room was on the second floor at the end of a hallway. So, it seemed like a long walk. But then we discovered that there was a stairway right next to his room that led right outside. So, it became apparent that he had just snuck down that little stairway and gotten right outside before passing away. Ultimately, after we figured this information out, we were able to settle the case quickly to get fair compensation for his loved ones.
