The biggest tactic we see from the defendants in these cases are delays, delays, delays, delays. So, if we request a deposition, if we request written discovery, they’ll attempt to delay things and push things out. Cases essentially have limited lifespans. The court will often give you a trial date, and that trial date is frequently set in stone. So it’s a bit of a race to get all the discovery you need before your trial date. The more delays you have to deal with, the more difficult that is.
So, one of the things Lanzone Morgan does is we are on top of defense counsel. We ask for things early, and if they don’t provide them, we bring motions to compel. We go to the court and we ask them to force defendants to actually provide those documents, those depositions, the information we need so we’re prepared for trial.
