ABUSE LAW FIRM

Placing your loved one in a nursing home is hard enough without having to worry about nursing home abuse. If you have noticed unexplained changes in your loved one’s health, mood, or behavior, they may be experiencing abuse. If something doesn’t feel right, trust your gut. Perhaps your loved one has been admitted to the hospital with a serious injury, or you have noticed that your loved one is asleep or in a mental fog every time you visit. Has your loved one become depressed or fearful since entering the nursing home?

You are right to be suspicious if these warning signs appear. We are an experienced law firm primarily focused on protecting the rights and welfare of the elderly. Call us immediately at (888) 887-9777 or contact us online if you suspect nursing home abuse. We can look into the care your loved one is receiving and help you get justice for any nursing home neglect or abuse your loved one has experienced.

Experienced Lawyers Who Fight Back Against Abusive Nursing Homes

We are a skilled elder abuse law firm relentlessly committed to safeguarding the rights and dignity of the elderly across California, including Riverside, San Bernardino, Moreno Valley, and the surrounding areas. Nursing homes are large corporations that seldom take responsibility for the harm residents suffer in their care. A nursing home abuse lawsuit is often the only means to stop abuse and receive fair compensation.

Our attorneys have over 75 years of combined experience standing up to nursing homes with a proven track record of holding them accountable. Since Anthony Lanzone and James Morgan founded our firm in 2008, we have recovered over $200 million in compensation for our clients.

California is our home, and we are familiar with Riverside County’s judges, attorneys, court system, nursing homes, and insurance companies. We often see the same offenders repeatedly, and they know our record. They often settle when they see we are involved because they know we pursue every case with passion and precision, and that we can win a significant verdict should the case go to trial.

We care about every client like family. When you choose us, you receive compassionate legal advocacy, counseling, resources, and 24/7 support.

A Law Firm You Can Trust When a Nursing Home Has Let You Down

Nursing home abuse is all we do, and this makes our law firm the top choice for handling your Riverside nursing home abuse claim. Focusing solely on nursing home abuse gives us deeper knowledge of the nursing home industry. We are able to handle cases with greater efficiency than law firms that split their focus between multiple practice areas.

Nursing home residents are vulnerable adults who often cannot report abuse or stand up for themselves. Nursing homes should be positive, caring environments where residents experience the highest quality of life possible. Instead, they take advantage of vulnerable residents to maximize profits. We use litigation to give a voice to the voiceless so they are not at the mercy of abusive nursing homes.

We are working to change the elder care landscape in California to protect older adults’ health, well-being, and dignity. We recently won a landmark California Supreme Court ruling that executing optional arbitration agreements does not fall within the purview of health care decisions authorized by health care powers of attorney. Such agreements deprive residents of their right to sue nursing homes for abuse in a jury trial. We will never stop fighting for nursing home abuse victims, and you can count on us to represent your loved one with passion and perseverance.

Reviews from Real People We Have Helped

When you choose us, we do not take your trust lightly. We go the extra mile to provide compassionate legal support and get the results you deserve. The following is an example of the feedback we regularly receive from clients:

“Lanzone Morgan, LLP, The absolute best attorneys you could ever have on your side when dealing with a tragic event to one of your family members (my mom in this case) being abused by a nursing home. The nursing home took full advantage of me knowing that I no longer lived locally in California. The fact that I lived on the East Coast and could not be there to keep track of everything going on with my mom every day, and make sure she was receiving the care she deserved from the very beginning… From the very first phone call I made to their (Lanzone Morgan, LLP) office, to the first voice on the other end, I just knew I was going to be in good hands and that they were going to see my mom and me through this tragic event. Over the next several months as they were handling my case, I had a few more conversations with Emily and was then introduced to my new paralegal Alexis, who also had the sweetest disposition and made you feel like she really cared about you and your case, just like Emily did from the beginning. As time went by and I began to deal with others as well as my attorneys, it was always the best experience. I always understood everything about my case at that time, and there were never any unanswered questions. I am big on first impressions, and it felt right from the very beginning, and now that my case has settled, I feel it’s only fair to give them the 5-star review they deserve! Whether you are local in California or all the way on the east coast, as I was, you can bet if you need an attorney to be by your side, Lanzone Morgan, LLP and their staff will be right there every step of the way. There is no amount of money that will bring back your loved ones, but knowing the nursing home was held accountable means the most to me.”

Common Causes of Nursing Home Abuse

The primary underlying causes of nursing home abuse include the following:

  • Understaffing: Low staff-to-resident ratios prevent staff from meeting residents’ needs and lead to staff frustration and burnout that may take out on residents.
  • Poor working conditions: Nursing home staff often work long shifts for low pay, increasing the risk of burnout and frustration.
  • High staff turnover: High turnover rates prevent residents from receiving continuous care from staff familiar with their needs.
  • Poor hiring practices: Poor working conditions and high turnover rates have created a nursing home staffing crisis. Many facilities have responded by failing to perform mandatory background checks or hiring staff without adequate credentials.
  • Inadequate training. Nursing homes often fail to properly train staff in important job functions, such as how to respond to residents with dementia-related behaviors, dispense medication properly, or report abuse.
  • Poor management. Nursing home administrators often fail to implement or enforce policies for such important functions as infection control, reporting abuse, or resident supervision.

Call Lanzone Morgan, LLP today at 888-887-9777 if your loved one is abused in a Riverside nursing home.

Compensation for Injuries in Riverside Nursing Homes

Compensation for injuries in Riverside nursing homes may include economic, non-economic, and punitive damages. Economic damages cover the financial costs associated with the injuries, such as your loved one’s medical expenses, any lost wages you experience protecting your loved one or pursuing justice, the value of stolen property, and projected future medical expenses. Non-economic damages cover subjective losses, such as pain and suffering, loss of enjoyment of life, and emotional distress.

In the event your loved one dies from nursing home neglect injuries, you may be entitled to wrongful death damages, which may include the following:

  • Funeral expenses
  • Your loved one’s medical expenses
  • Mental grief and suffering
  • Loss of companionship
  • Loss of parental guidance
  • Punitive damages

Punitive damages are only awarded in rare cases when you can prove the nursing home harmed your loved one intentionally, committed fraud, or was grossly negligent.

How Much Your Nursing Home Abuse Case May Be Worth

Your damages will vary based on the severity of the injuries, the type of case you file, the strength of your evidence, and whether you qualify for punitive damages. The following are some notable nursing home abuse settlements and verdicts we have obtained:

Case Results

Many nursing home neglect cases involve medical malpractice claims, which have limits on non-economic damages. As of 2025, the non-economic damages limit is $430,000 if the victim survived or $600,000 in a wrongful death claim. These caps are adjusted annually.

Some nursing home abuse cases are elder abuse cases, which carry no limits on compensation. We are dedicated to maximizing your compensation. We won’t accept less than your loved one deserves, and we are proven trial lawyers who will be ready to take your case to trial if the insurance company refuses to pay fair compensation.

What Responsibilities Do Riverside Nursing Homes Have to Their Residents?

Code of Federal Regulations § 483.10 and Title 22 § 72527 of the California Code of Regulations give nursing home residents the right to live in a home-like environment, free of neglect and abuse. Nursing home resident rights include the following:

  • The right to participate in care planning and make decisions about their care, or designate a surrogate to make decisions for them
  • The right to decline medical treatment or leave the facility
  • The right to appetizing food that meets nutritional needs and accommodates preferences and allergies
  • The right to be free of medically unnecessary chemical and physical restraints
  • The right to be treated with respect and dignity
  • The right to receive visitors at the time of their choosing
  • The right to manage financial affairs

Nursing homes often neglect the most basic resident rights. Residents usually have physical or cognitive limitations that make them easy targets for abuse and neglect. Taking advantage of elderly and dependent adults is illegal and immoral.  If a nursing home violates your loved one’s rights, we will be ready to fight for the justice they deserve.

"We know the ins and outs of nursing home litigation. We know how the long-term care industry operates. Because we know how they operate, we're in the best position to get the best results for the clients."

Stories of Abuse in Riverside Nursing Homes

Approximately 16 percent of older adults living in U.S. care facilities experience abuse, according to SeniorLiving.org. The most common forms of abuse are physical abuse, neglect, and mental abuse. Nursing home abuse occurs in nearly every community, including Riverside and the surrounding cities. Many abuse incidents never receive public attention. However, a few cases have made the headlines in recent years, primarily because they led to criminal charges.

According to the Associated Press, Emily Jones, a registered nurse at Brookdale Senior Living in Riverside, was charged in 2021 with felony elder abuse. Prosecutors alleged that she failed to assess a skin ulcer on a resident’s heel, which developed a fatal gangrene infection. According to the criminal complaint, Jones failed to notify the doctor or the family about the resident’s declining condition. She pleaded guilty to the charge.

In 2023, the California Attorney General announced that three caregivers at Secure Hands, an unlicensed Riverside care facility, were convicted of neglecting and abusing six residents, ages 32 to 66. The victims were starved, living in squalor, and deprived of care when authorities discovered them, according to the Attorney General’s statement.

The Widespread Problem of Nursing Home Abuse in the Inland Empire

The stories reported in the news are not isolated incidents in Riverside. According to ProPublica, 12 area facilities received citations for serious deficiencies during the last three years.

Meanwhile, the following seven facilities are flagged for abuse-related citations on Medicare.gov:

  • Community Care on Palm in Riverside
  • Meadow Ridge Care Center in Colton
  • Reche Canyon Regional Rehab Center in Colton
  • Park Avenue Healthcare & Wellness Center in Pomona
  • Highland Springs Care Center in Beaumont
  • Laurel Park Behavioral Health Center in Pomona
  • Vista Real Post Acute in Beaumont

In addition, Riverside Post Acute Care has been designated a Special Focus Facility. Special Focus Facilities are nursing homes with longstanding serious deficiencies. The state selects facilities for the program based on health inspections and complaints. Special Focus Facilities receive heightened oversight and progressive enforcement until they fix the problems. If they fail to come into compliance, they can lose their licenses. Riverside Post Acute has had 118 complaints during the last three years and 51 citations, compared to a state average of 16.1.

If a nursing home has stopped communicating with you or your loved one has developed bedsores or other serious injuries, you may have grounds to file a nursing home abuse lawsuit.
